By accessing or using Podbloom ("Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
Podbloom is a podcast creator platform that provides tools for:
- Extracting host-read advertisements from podcast audio content via automated transcription and analysis
- Analyzing podcast RSS feeds and episode descriptions to identify sponsor mentions and promotional content
- Creating and managing shareable advertisement display pages
- Analytics and performance tracking for creators
- Subscription-based access to premium features
- Content management and editing tools
- Flexible processing options allowing users to choose audio transcription, description analysis, or both
3. User Accounts
3.1 Account Creation
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 13 years old to create an account (or 16 in EU)
- Business accounts may be subject to additional verification requirements
3.2 Account Responsibilities
- You are solely responsible for all activities under your account
- You must notify us immediately of any unauthorized access
- We reserve the right to suspend or terminate accounts for violations of these Terms
4. Acceptable Use
4.1 Permitted Uses
You may use Podbloom to:
- Extract and display advertisements from your own podcast content through audio transcription and/or RSS description analysis
- Create shareable pages for legitimate promotional purposes
- Access analytics and performance data for your content
- Choose your preferred processing methods (audio, text, or both) based on your content strategy
4.2 Prohibited Uses
You may not:
- Upload content you do not own or have rights to use
- Extract advertisements from third-party content without permission
- Use the platform for illegal, harmful, or fraudulent activities
- Attempt to reverse engineer, hack, or compromise the platform
- Spam, harass, or abuse other users or the platform
- Violate any applicable laws or regulations
- Share account access with unauthorized parties
- Use automated systems to access the platform without permission
- Submit content that violates third-party intellectual property rights
5. Content and Intellectual Property
5.1 Your Content
- You retain ownership of your original podcast content, including audio files and episode descriptions
- You grant us a limited license to process, display, and distribute your content as necessary to provide the Service, including:
- Transcribing audio content for advertisement extraction
- Analyzing episode descriptions and RSS feed content
- Storing and processing extracted advertisement data
- Creating shareable advertisement display pages
- You represent that you have all necessary rights to your uploaded content
- You are responsible for ensuring your content complies with applicable laws
- You understand that audio files are temporarily processed for transcription and then securely deleted
5.2 Platform Content
- Podbloom owns all rights to the platform, including software, algorithms, and extracted data processing technology
- You may not copy, modify, or redistribute our proprietary technology
- Trade names, trademarks, and service marks are our property
5.3 Extracted Advertisements
- Extracted advertisements remain subject to original copyright and trademark protections
- You are responsible for ensuring compliance with advertising regulations
- We do not guarantee the accuracy or completeness of extracted content from either audio or text sources
- Advertisement extraction is provided as an automated service and may require manual review for accuracy
6. Subscriptions and Payments
6.1 Subscription Plans
- Access to certain features requires a paid subscription
- Subscription fees are charged in advance on a recurring basis
- All fees are non-refundable unless required by law
- Different subscription tiers may include varying limits on audio transcription and processing capabilities
6.2 Payment Processing
- Payments are processed through third-party providers (Stripe)
- You authorize us to charge your selected payment method
- You must maintain valid payment information for active subscriptions
6.3 Cancellation and Refunds
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- No refunds for partial periods unless required by applicable law
7. Privacy and Data Protection
7.1 Data Collection
- We collect information as described in our Privacy Policy
- You consent to our data practices as outlined in the Privacy Policy
- We may use aggregated, anonymized data for platform improvements
7.2 Content Processing
- We may process your podcast content to extract advertisements through:
- Audio transcription services (when selected)
- RSS feed and episode description analysis
- Automated content analysis and advertisement identification
- Processing is automated and necessary for service functionality
- We implement appropriate security measures to protect your data during all processing activities
- Audio files are processed temporarily and then securely deleted in accordance with our data retention policies
8. Platform Availability and Modifications
8.1 Service Availability
- We strive for 99.9% uptime but do not guarantee uninterrupted service
- We may perform maintenance that temporarily affects availability
- We are not liable for service interruptions beyond our reasonable control
- Third-party transcription and AI services may occasionally experience outages that affect platform functionality
8.2 Platform Changes
- We may modify features, pricing, or terms with reasonable notice
- Continued use after changes constitutes acceptance of modifications
- We may discontinue features or the entire service with 30 days' notice
9. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:- MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- ACCURACY OR COMPLETENESS OF EXTRACTED CONTENT FROM AUDIO OR TEXT SOURCES
- UNINTERRUPTED OR ERROR-FREE OPERATION
- COMPLIANCE WITH YOUR SPECIFIC BUSINESS NEEDS
- ACCURACY OF TRANSCRIPTION SERVICES
- COMPLETENESS OF ADVERTISEMENT IDENTIFICATION
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- WE ARE NOT LIABLE FOR LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES
- WE ARE NOT LIABLE FOR ERRORS IN TRANSCRIPTION OR ADVERTISEMENT EXTRACTION
- SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS
11. Indemnification
You agree to indemnify and hold us harmless from claims arising from:
- Your use of the platform
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload or process through the platform
- Your use of extracted advertisement data
12. Termination
12.1 Termination by You
- You may terminate your account at any time
- Termination does not relieve you of payment obligations
12.2 Termination by Us
We may terminate or suspend your account for:
- Violation of these Terms
- Non-payment of fees
- Illegal or harmful activity
- Extended period of inactivity
- Abuse of transcription or processing services
12.3 Effect of Termination
- Your access to the platform will cease immediately
- We may delete your data after a reasonable retention period
- Audio files and transcripts will be deleted in accordance with our data retention policy
- Surviving provisions include payment obligations, disclaimers, and limitations
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by US law without regard to conflict of law principles.
13.2 Dispute Process

- If unresolved within 30 days, binding arbitration may be required
- Arbitration will be conducted by Podbloom's selected arbitration service
- Class action waiver applies where legally permissible
